Rezumat:Although the ethno-cultural identity is an undeniable anthropological fact, it is regarded with reserve. The claims of identity are seen as a potential threat to human rights and democracy in general. Anthony Smith identified the symbolic processes through which the majority ethnic groups have the tendency to turn into national states, associating a territory, a homeland. Based on the experience of some multicultural countries, the deontological liberalism (Rawls) claims the neutrality of public space and send the cultural differences in the private sphere, along with other optional affiliations and moral convictions of people. The Canadian philosopher Charles Taylor argues that the cultural difference must have relevance in organizing the public space by applying the recognition policies. This means that the protection of individual natural rights must be accompanied by the recognition of the collective rights: the rights of minorities (Kymlicka) or the cultural rights (Taylor, the group of Fribourg). I am interested to explore the anthropological foundations of ethnicity and to restore a line of romantic interpretation of cultural rights, which begins with Herder and is taken over by the communitarians today.
